CONSTITUTIONAL AMENDMENT ELECTION - NOVEMBER 7, 2023

Let's look at what's on the ballot:

Proposition 1

Establishing the right to engage in farming, ranching, timber production, horticulture, and wildlife management. This would limit state or federal intrusion on property owners' rights. Read more here about this property-rights-focused effort! VOTE YES.

Proposition 2

Authorizing property tax exemptions for child-care facilities. There's no free lunch, and the cost of this charming idea would be borne by an increase in property taxes from local governments scrambling to cover decreased tax takings. VOTE NO.

Proposition 3

Prohibiting a tax on the net worth or wealth of individuals. This pro-active measure would keep Europe's failed wealth tax initiatives out of Texas! This raises the bar, requiring 100 House and 20 Senate votes to ever institute it. VOTE YES.

Proposition 4

Authorizing the Legislature to establish property tax relief measures. Simply, this proposition uses our State surplus to lower school property taxes for home and business owners. A $100,000 property tax exemption for primary residences; a temporary 20% limit on annual value increases for some commercial properties; and franchise tax savings for small businesses. VOTE YES.

Proposition 5

Establishing the Texas University Fund for emerging research universities. Four Universities - Texas Tech University, the University of Houston, the University of North Texas and Texas State University - would qualify for the $272 million research endowment. NEUTRAL: Oppose if you think the Rainy Day Fund has better uses, Support if you think funding our research universities would strengthen Texas' workforce.

Proposition 6

Creating the Texas Water Fund for financing water projects. The Texas Water Development Board would oversee this Fund, which would support new and existing water projects across the state. We can better manage our surface water and groundwater! VOTE YES.

Proposition 7

Establishing the Texas Energy Fund for electric facility construction and upgrades. Managed by the Public Utility Commission, this fund would foot the bill for continued construction, maintenance, & operations, to strengthen our electric grid. VOTE YES.

Proposition 8

Establishing the Broadband Infrastructure Fund. Our Texas Comptroller of Public Accounts will oversee this effort to expand high-speed internet access in our rural areas and statewide. NEUTRAL: Oppose if you think this problem would be best solved by private sector initiatives, Support if you think $5 billion from our surplus should be used to address this issue.

Proposition 9

Authorizing a cost-of-living adjustment for retired teachers. This long-overdue adjustment for educators will be staggered - retired prior to 2001: 6%, retired 2001-2013: 4%, and retired 2013-2020: 2%. VOTE YES.

Proposition 10

Exempting certain property held by medical manufacturers from taxation. This aims to incentivize the bio-medical manufacturing industry here in Texas. NEUTRAL: Oppose if you think these property tax exemptions for certain industries mean higher taxes for others, Support if you think these industries would use these tax savings for advancements or simply lowering their costs.

Proposition 11

Authorizing El Paso County special districts to issue bonds for parks development. Like in other such districts around Texas, voter-approved bonds would increase taxes further for this local area. These Texans are taxed plenty already. VOTE NO.

Proposition 12

Abolishing Galveston County’s Office of County Treasurer. While all Texas voters can vote on this proposed Constitutional Amendment, it only takes effect if a majority of Galveston County voters then also authorize it. NEUTRAL: Oppose if you think this is a vital role, Support if you think this would lighten bureaucracy or be more efficient.

Proposition 13

Increasing the mandatory retirement age for state justices and judges. For justices and judges on appellate, district and criminal district courts, this would raise the mandatory retirements age from 70-75 years old, to 75-79 years old. NEUTRAL: Oppose if you think the current age of 75 is a reasonable mandatory retirement age, Support if you think this stabilizes our judicial system's staffing.

Proposition 14

Creating the Centennial Parks Conservation Fund. This would to be used for the creation and improvement of parks around the State. We love our parks! But Texans are already struggling and over-taxed, and we need to return that tax money to taxpayers. VOTE NO.
